“TO SAY OR NOT TO SAY?” - An Analysis of the UK Supreme Court Decision in Halliburton v Chubb
In the recent case of Halliburton v Chubb the UK Supreme Court was presented with an opportunity to determine the circumstances in which an arbitrator is required to make conflict of interest disclosures. In this article, our Partner Oyinkansola Badejo-Okusanya and Senior Associate, Orji A. Uka examine whether (and the extent to which) the Supreme Court succeeded in doing so, and also discuss the decision’s potential impact on the practice of international commercial arbitration in general and in Nigeria in particular.
